Overview of the Los Angeles Eviction Process
A tenant eviction is not a simple process, even for a Los Angeles property management company. By California law, “A landlord can terminate (end) a month-to-month tenancy simply by giving the tenant 30 or 60 days' advance written notice.”1 However, only three days notice is required when any of the following has occurred:
- Failure to pay rent;
- Violation of the lease or rental agreement;
- Infliction of material damage on the rental property;
- Substantial interference with other tenants;
- Domestic violence or sexual assault against or stalking of another tenant;
- Use of the rental property for any unlawful purpose;
- Drug dealing or the unlawful use, cultivation, importation, or manufacture of illegal drugs;
- Use of the rental property to conduct dogfighting or cockfighting;
- or unlawful conduct with weapons or ammunition.
If the tenant does not voluntarily vacate the rental property after the proper notice has been given, an eviction can begin by filing an unlawful detainer lawsuit. According to the California Department of Consumer Affairs, “An unlawful detainer lawsuit is a "summary" court procedure.This means that the court action moves forward very quickly, and that the time given the tenant to respond during the lawsuit is very short.”2 If the case is taken to court, a judge will generally hear and decide the case within 20 days of the case going to trial.
